Terms
Photo and video Rights and Usage for Commercial Real Estate:
Our commercial photos and videos come with a non-transferable non-exclusive royalty-free limited right license which allows the client who paid for our services a limited royalty-free, sublicensable and transferable license to use, reproduce, modify, resize, adapt, prepare derivative works of, distribute, and display the Images for any lawful purpose, and to modify permission to use the images and videos on any electronic or printed form of advertisement for the promotion and sale of the commercial real estate during the term of the listing agrement.
Images and videos cannot be sold or used by another commercial agent or firm. If another commercial agent or firm takes over the listing they cannot use the images of videos without written permission from Mark Jacobs Productions. You may not copy, modify, reproduce, create derivative works, distribute, transmit, license, or sell any content, image or any portion of the Mark Jacobs production without the prior written consent of Mark Jacobs Productions after the property is sold, expired and removed from the market. Generally, Mark Jacobs Production will grant permission for such use so long as Mark Jacobs Productions is properly acknowledged, but the prior express written consent of Mark Jacobs Productions is required. The client does not have authorization to sell, transfer, or give away any media for any reason without written consent from Mark Jacobs Productions. Client does not have authorization to modify, change or edit the original media/photos or have a third party modify, change or edit media/photos without permission from Mark Jacobs Productions the copyright holder. Client may modify the media/photos only if they have purchased the copyright. Please do not send media/photos to a third party to be modified or changed. Contact Mark Jacobs Production for any modifications or changes.
Artistic Style Release: [Client] has spent a satisfactory amount of time reviewing Mark Jacobs Productions portfolio/work and has a reasonable expectation that Mark Jacobs Productions will perform the services in a similar manner and style unless otherwise specified. If the agent is looking for a specify style or look other than the style displayed in the portfolio, agent should contact Mark Jacobs Production prior to ordering. Mark Jacobs Productions will use reasonable efforts to ensure the desired services are produced in a style and manner consistent with Mark Jacobs Productions portfolio and will try to incorporate any reasonable suggestion made by Client.
Builders, stagers, designers, commercial property owners and others who wish to use the images and videos for commercial real estate taken by Mark Jacobs Productions. Agent should contact Mark Jacobs Productions for specific licensing fees and information. Any usage of any media by a third party is strictly prohibited unless prior written approval is given by Mark Jacobs Productions. The original Client does not have authorization to sell, transfer, or give away any media for any reason without written consent from Mark Jacobs Productions.
Rescheduling Fee:
TThere is no fee to reschedule a shoot with a 24-hour notice. For shoots rescheduled with less than 24-hours, a $75 rescheduling fee will be added to the invoice. For shoots rescheduling the same days as the shoot a $200 rescheduling fee will be added to the invoice.
Cancellation Fee:
Orders can be canceled for any reason with a 24-hour notice Monday thru Thursday. There is a processing fee of 3.3% + 30 for all refunds. Shoots scheduled for Mondays need to be canceled by Friday 5 pm (Saturday and Sunday are non business days). For orders canceled with less than a 24-hour notice, Mark Jacobs Productions charges 50% of the total shoot cost. This will show as a line item on the invoice. If, a shoot is rescheduled with less than a 24-hour notice, then canceled with a 24-hour notice. The shoot will be invoiced at 50% of the total shoot.
Payment Terms: 50% paid at booking balance due 10 days after delivery or at media download.
